Session #101 · 1989–91

Speech #1010059730

The rights of American workers should not fall victim to unfair competition from foreign workers. This legislation is a companion bill to H.R. 285a bill introduced in the House of Representatives by Congresswoman MARGE ROuKIEA. As a result of a loophole in our immigration law. nonimmigrant aliens may be hired to replace striking American workers on international air and sea routes. In other industries. nonimmigrant aliens are specifically prohibited from working as strikebreakers. This is simply not fair. When the Immigration Reform and Control Act was passed in 1986. it contained a provision preventing the admission of nonimmigrant alien crewmembers as replacement workers during a strike. The provision was approved in conference. but the conference committee provided for a 1year sunset. in order to give Congress time to study the issue. The time period elapsed on November 5. 1987. with no action by Congress.
