Those employees of the Department of Energy directly responsible for handling nuclear weapons or nuclear fuel are exempt. The Central Intelligence Agency is exempt. The Bureau of Prisons is exempt. The Drug Enforcement Administration is exempt. The FBI is exempt. Immigration and Naturalization Service is exempt. The Department of the Army is exempt. Now. the Department of the Army is exempt because it had a testing process procedure in being as of the issuance of the Executive order.
