The district did not appeal the denial of its recruitment reduction request because it was told by the INS that it was the duty of Dr. Mastroyanis to appeal. This was inaccurate. and before this could be straightened out. the time for appeal had expired. The district reapplied for a permanent work visa in the fall of 1985. Its recruitment reduction request was again denied. but this time because of the "apparent availability of applicants on file with the State Employment Service." There may have been "an apparent availability of applicants for the job on file with the State Employment Service." but it appears that DOL failed to determine whether the applicants were as equally qualified for the job as Dr. Mastroyanis.
