They are not citizens. They must remain in that status for 5 years. and then they may go forward to citizenship. and in doing so. they must pass all the tests for citizenship. The 90day provision is limited to a very small number of illegal immigrant population. and that is agriculture. Under that. they have to remain 3 years. they have to have been here 3 years. They must have worked 90 mandays a year for 3 consecutive years. with a residency requirement. and then they are temporary for a year. and then they go to permanent resident alien status. another 5year wait.
