If the gentleman will yield. yes. the gentleman from California is correct. The statement on the part of the managers which was included stated that it is the intent of the conferees that contracts entered into shall not violate any provision of the Immigration and Nationality Act. authorizing the H2 program or any regulations issued pursuant to the act. As chairman of the House conferees I want to state that the colloquy initiated by the gentleman from Florida overreaches and contradicts the language of the conference report as well as the statement of managers. When we provided that it was our intent that H2A contracts "shall not violate any provision of the Immigration and Nationality Act authorizing the H2 Program or any regulations" and went on to authorize legal services representation to secure "the rights* * *under the* * *contract." we obviously intended that such workers could use Legal Services attorneys to sue not only to enforce breaches of their contract but also. obviously. when those contracts violated the act or regulations. To hold otherwise is to deny the plain meaning of those two dictates. For it would allow an employer to offer illegal contracts that violate the law. but allow suit if. and only if. there was a breach of thoseillegalterms.
