Based on my review. I believe that the more appropriate way to have dealt with this matter would have been to interview the persons involved after the issuance of a notice or summons to appear rather than having them arrested and taken into custody. As you know. the Immigration Act defines the standard for asylum as a showing that the person "has a wellfounded fear of persecution on account of race. religion. nationality. membership in a particular social group or political opinion." Based upon the information supplied to me. it appears that the Philadelphia family that was taken into custody would categorically qualify for asylum.
