Mr. Chairman. this amendment attempts to clean up a proposition which is fundamentally flawed. What it attempts to do is to state that when there are two applicants for a job who are equally qualified. one of whom is a U.S. citizen and another of whom is not. but does have a green card. it is not illegal to hire the U.S. citizen over the alien who is allowed to work. Now what is wrong with that? It seems to me that when there are two equally qualified people applying for a job. the employer ought to be able to choose whomever he wants. and not be subject to a charge of discrimination.
