H.R. 3737 is designed to discourage aliens from entering into fraudulent marriages to attain permanent U.S. residency. The bill provides a 2year "conditional" residency period after which the couple must establish to the satisfaction of the Attorney General that the marriage was not entered into fraudulently. and creates criminal penalties for marriage fraud. U.S. immigration laws has been appropriately tailored to prevent separation of families. Unfortunately. these provisions have been abused. with aliens entering into fraudulent marriages to circumvent the regular preference system. The two most common types of marriage fraud involve cases in which a U.S. citizen accepts cash or other consideration in exchange for marriage vows and those in which an alien marries a U.S. citizen only to abandon the spouse following receipt of a green card. I am hopeful this legislation will help correct this problem by discouraging fraudulent marriages. I understand the Senate has already passed a similar bill and is anxious to complete action on this legislation this year.
