Speaker. I also rise in support of H.R. 3737. Congressman MCCOLLUMS bill. which tightens up provisions in the Immigration and Nationality Act to discourage individuals from entering into fraudulent marriages in order to attain permanent residency. We frankly do not know what the statistics are here. It was very difficult in the past to prove. basically because we have not had standards with which the INS could work. Yet anectdotal information that we have. plus estimates from some in the Service. have indicated that this is one major way in which people have gotten around the law and come in while others were left behind standing in line following the law. This bill contains a 2year conditional resident requirement for spouses. Anyone immigrating on the basis of a marriage entered into with a U.S. citizen would have conditional permanent residency for 2 years. Ninety days before the 2year marriage anniversary. the couple would have to establish. to the satisfaction of the Attorney General. that the marriage was proper and not entered into fraudulently. The burden of proof is on the Attorney General to prove the marriage was entered into fraudulently.
