I do not think this amendment ought to be controversial. Under the law today. I think there is a possible loophole in our immigration laws which could serve to inadvertently benefit those convicted of drug offenses. Under the present law a sentencing judge has the authority to make a binding recommendation to the Attorney General that an alien convicted of a variety of Federal offenses not be deported. In other words. at the time the conviction takes place. the Federal judge can say. "But I do not want this person to be deported." That is a binding recommendation to the Attorney General the person cannot be deported. However. we have made one exception to that binding recommendation authority. We have said that in drug cases that authority is not binding.
