Veterans who have been victimized by arbitrary or capricious VA decisions have no recourse to legal appeal. By law. they are denied the basic constitutional right of due process when it comes to appealing decisions of the Board of Veterans Appeals. This right is granted throughout the Federal Government to groups ranging from Federal prisoners. to welfare recipients. from illegal aliens to military personnel. All have access to the Federal courts for review of disputed agency decisions. The injustice to veterans under current law is compounded by the fact that even though veterans are denied the right to challenge VA decisions in court. the VA is allowed to go to court if it believes that a veteran owes it money.
