Under section 1013 of the original act. Congress may override any deferral by the President by passing an impoundment resolution disapproving the deferral in either the House or the Senate. In 1983. the Supreme Court. in Immigration and Naturalization Service versus Chadha. held that this "oneHouse veto" violated the principle 9f separation of powers and the lawmaking requirements of article I of the Constitution. Because this unconstitutional veto provision was not intended to be severable from the rest of section 1013. the President has no remaining power under the law to defer budget authority. As the legislative history of the Impoundment Control Act clearly shows.
