While the new definition may cut back the numbers of students claiming to be independent. and therefore should provide cost savingsI remain concerned that a certain group of students may be adversely affected by this definition. In Minnesota. where a similar definition has been implemented this year. a number of students affected by the age limit have appealed to the higher education coordinating board. These students are children of divorced parents. children asked to leave home. students unable to locate parents and refugees from other countriesand obviously consider themselves legitimately independent. While initially determined dependent for purposes of financial aid in Minnesota. they are at least able to proceed through an appeals process where a large majority of these claims are being decided in favor of the students. The H.R. 3700 definition does include a provision whereby the student financial aid administrator may determine a student "independent" due to "unusual circumstances." This provision provides some flexibility. but also rUlows for much inconsistency in determinations.
