In the Oliver case. they were dealing with the question of growing crops. plants growing in the field. marijuana plants in that particular instance. They were not talking about human beings presence there and the search of the premises for people. They were talking about the search of the premises for growing plants. And there is a reason to make that distinction. The reason I make it now is obviously to differentiate between law enforcement activities where they are trying to find growing plants and law enforcement activities when they are trying to determine the presence of illegal aliens. But there is a similar tie to that. How do drug enforcement agencies find growing marijuana plants?
