Mr. President. this amendment to the Immigration Reform and Control Act of 1985 would require the Immigration and Naturalization Service [INS] to obtain a properly executed search warrant prior to entering a farm or other agriculture operation. Currently. INS agents must obtain a warrant before entering any place of business with the exception of farms and ranches. This exception must not be allowed to continue. Farmers should be afforded the same rights and standards of protection that every other businessman enjoys under the fourth amendment of our Constitution which guarantees protection from unreasonable search and seizure. Similarly. every farm worker is entitled to the same protection as every other worker in our society against the disruption that occurs when there is unwarranted and sometimes warrant. lesswithout warrantsearch of farm premises.
