The Department of Labor would appropriate $10 million annually to assist in this effort. A seasonal workers ability to participate in the program would be based largely upon his or her experience in the production of perishable commodities. Workers would be given visas that would. in most instances. admit them to work for a period not to exceed 9 months. Strong incentives are provided to encourage workers to return to their countries of origin by withholding 20 percent of their wages. which would be returned to them through the U.S. consulate in their country of origin upon their return and proof of compliance with terms of the visa. including the requirement of continuous employment in perishable agriculture. If workers are not continuously employed. they must leave the United States. Failure to do so within 30 days of their last verifiable employment could result in forfeiture of their withheld wages.
