The bill before us this afternoon has the strong support of the American Bar Association. the Association of the Bar of the city of New York. and the American Civil Liberties Union. This is so because the bill dramatically improves Federal law by providing the Federal courts with authority to refuse to extradite a person if that person establishes by a preponderance of the evidence that the persons return will result in either impermissible persecution or subject the person to fundamental unfairness. This safeguard is derived from the United Nations Convention and Protocol on the Status of Refugees and parallels the treatment given to alleged offenders in virtually all modern democracies. Great Britain. the Federal Republic of Germany. Israel.
