The Energy and Commerce amendments do not alter the basic framework of the Judiciary bill. Legalized aliens who are otherwise eligible for medicaid would. as a general rule. still be denied medicaid coverage for 5 years. However. the Energy and Commerce amendment does clarify the exceptions to this prohibition. First. the amendment makes clear that the prohibition on eligibility does not apply to any public health service program. including the community or migrant health center programs. or to the maternal and child health services block grant. Unlike medicaid. these are not individual entitlements. Instead. they make services available to broad classes of people. such as mothers and children or residents of medically underserved areas.
