I suggest that the law is full of distinctions between things you can do in the privacy of your home and things you can do out in the open. even if its your backyard or front lawn. To tell me that you cannot do something in your bedroom because you cannot do it on your front lawn is. I think. a fact to be wrong. Privacy is clearly an important value where we have structures. Now the question is the argument has been made that we are somehow assuming that most of the illegal aliens who work here are agricultural workers. That is not true. Nothing in this amendment says that.
