I commend the gentleman from Massachusetts for this amendment because it addresses a very specific and very fundamental problem with this bill. There is no doubt in my mind and in the minds of many Members of this House and the American public that the employer sanctions which are in H.R. 1510. as reported out of the committee. can. in fact. result in discrimination against certain potential employees. In the Southwest United States. those most susceptible to being the victims of discrimination would be the persons of Hispanic descent. or persons who look or sound foreign born. This potential for discrimination results primarily from the criminal sanctions against employers. The Frank amendment does not remove those criminal provisions. but this House will have the opportunity to do so at a later time.
