At time of fiscal austerity. there is no need for Congress to create another EEOC. Under present law. only persons employing 15 or more employees are subject to title VIIs employment discrimination prohibitions. The committee amendment. by permitting the Immigration Board to hear complaints of unfair treatment filed against persons employing more than three individuals. would effectively eliminate this exemption. Under H.R. 1510. therefore. "Mom & Pop" companies would not only be subject to criminal sanctions for violation of immigration laws. they would have to defend themselves against employment discrimination claims as well. There are additional problems related to alienage discrimination. One is that no one is sure exactly what it is under the committee proposal.
