Funds provided for land acquisition in this Act may not be used to acquire lands for more than the approved appraised value (as addressed in section 301(3) of Public Law 91646) except for condemnations and declarations of taking. without the written approval of the Committees on Appropriations. According to the Solicitors Office. one interpretation of this language in light of the June 23. 1983. Supreme Court decision in Immigration and Naturalization Service v. Chadha. 51USLW 4907. is that the final clause. "without the written approval of the Committees on Appropriations". would fall in a legal test of its constitutionality. This. the Solicitors Office believes. would leave the Department without authority to purchase any land "for more than the approved appraised value" except for condemnations and declarations of taking.
