Session #97 · 1981–83

Speech #970225381

If it is not workable. we are deluding ourselves. The other side of that is the employer problem. not just the paperwork burden but the hazard of making an error in the paperwork or preserving the paperwork in the event he is charged with criminal action. he has to be able then to defend himself. I know the argument is. and I have made it with a number of people with whom I have discussed this problem over the last several years. that you can be exposed to a civil penalty in which a bureaucrat. whoever it may be. in this case the Immigration and Naturalization Service. simply makes a charge against a person and you are subject to civil penalties. You must defend yourself against those civil penalties. you have no presumption of innocence. You do not have the value that comes from a jury trial. a jury of your peers in your own community.
