Opponents of the amendment may argue that now is not the time to consider the legislative veto. that the Congress should wait for a definitive Supreme Court ruling on this issue before moving ahead. Unfortunately. it may be a number of years before the constitutional questions surrounding the legislative veto are fully resolved. The Chadha case. currently before the Supreme Court. is not likely to provide a definitive ruling on this issue. It involves a congressional veto over a formal adjudicative derision pertaining to the deportation of one individual. as opposed to a legislative veto over agency rulemaking. The other major case in this area. Consumer Energy Council of America against FERC. which does apply to rulemaking. is presently on appeal to the Supreme Court.
