Future claimants. of course. will once again be subject to the old citizenship requirements. The Ways and Means Committee is especially concerned about the precedent this bill sets with respect to noncitizen claimants. because similar claimants come forward each year during the annual review of MFN agreements with nonmarket economics. They usually ask that MFN treatment for a particular country be withdrawn until their claims are satisfied. This causes a great deal of uncertainty for U.S. businesses in those countries and others who depended on the continued favored market treatment that MFN provides.
