I would certainly answer the gentlemans question directly. yes. that the limitation of preference rights is well within the power and the authority of Congress as demonstrated by the several memoranda that were provided to us and by the specific case of Fiallo v. Bell. 430 U.S. 787. a 1977 case. which. while dealing with a different subject matter. concluded that the legislative decision process on the part of Congress regarding immigration is virtually plenary and that it is solely the responsibility of Congress and wholly outside the power of the court to control matters of immigration. So I would answer the gentlemans question in the affirmative. When I earlier asked permission to insert. as a part of this record. the legal treatises which were provided to us which dealt with this very point.
