To impose FLCRA requirements on the fixedsite agricultural employer who is already held responsible for his treatment of workers under the Fair Labor Standards Act. the WagnerPeyser Act. the Federal Unemployment Tax Act. the Occupational Health and Safety Act. and the Federal Insecticide. Fungicide. and Rodenticide Act. to name a few. is simply unnecesary and burdensome. The Farm Labor Contractor Registration Act is an imoortant part of the protections we have provided for migrant workers. Unfortunately. the Devartment of Labor has decided in an increasing number of cases that farmers and other ariciiltural emolovers. or their emrnovees. are reouired to reeister as farm labor contractors under this act. It is a great irony thqt the Department of T.abor is now trying to regulate under this act the very Dersons Congress was tryinr to nrotect with it. This action by the Labor De artm nt it. unjustified. It casts a bad light on the entire law and the purposes that we are trying to achieve with it. The purpose is to protect migrant workers and farmers. The Denartments implementation makes it look like the purpose is to hnrass farmers. Its implementstion is diverting attention and resources away from the basic purpose of protecting migrant workers from abuse by unscrupulous crew leaders. I believe our amendments should be adopted in order to insure the proper implementation of this act.
