The present bill eliminates from the earlier Senate version an exception from the acts coverage for contractors who recruit less than 13 weeks a year within a 25mile intrastate radius. as an unnecessary loophole to effective enforcement. It eliminates a requirement that each registrant post a $5.000 bond upon registration. and also permits the Secretary of Labor to accept liability insurance in amounts less than that required by the Interstate Commerce Commission in extraordinary situations where the Secretary. after a special determination. finds that insurance coverage applicable to owners of other vehicles subject to Interstate Commerce Commission regulations is unavailable as to vehicles of farm labor contractors on a comparable basis. The bill revises penalty provisions under the act to provide that criminal penalties shall apply to violations of the act itself. whereas civil money penalties. imposed through the Secretary. shall apply to violations of regulations promulgated under- the act. subject. however. to two variations: first. a contractor who violates section 6(f) of the act. or regulations thereunder. by the knowing employment of illegal aliens. upon conviction may be fined not to exceed $10.000 or sentenced to a prison term not to exceed 3 years or both. wherever the contractor is not duly registered under the act. second. the use by another person of an unregistered farm labor contractor may result in the denial to that person of employment service facilities under the WagnerPeyser Act. These two sanctions exist in addition to any criminal or civil liability otherwise provided. The compromise bill retains the section creating a private Federal remedy for violations of the act or regulations by any person.
