In addition. the subcommittee established an additional safeguard by inserting a proviso which would specifically exempt from civil and criminal liability any employer who makes a bona fide inquiry as to the eligibility of a prospective employee to work in the United States. Another section of the bill would provide that receipt by the employer of a signed statement in writing that the employee is a U.S. citizen or a permanent resident alien would be deemed prima facie evidence that a bona fide inquiry has been made. This legislation has been very carefully prepared in an effort to eliminate the adverse effect of illegal aliens on the American economy and the domestic labor market and at the same time. it is designed to insure that members of ethnic and minority groups will not be disadvantaged. In fact. numerous witnesses noted that such individuals who have traditionally been denied opportunities to improve their skills will derive substantial benefits by the enactment of this legislation. In this regard.
