I think for the record it should appear that the fiance who marries a U.S. citizen within 90 days after temporary admission would become a permanent resident of this. country through regular immigration procedure. A petition would be filed by the American citizen to exempt the alien spouse from the annual numerical limitation on visa issuance. Upon approval of the petition the alien spouse. regardless of place of birth. would be eligible to apply for permanent resident status under section 245. The required fee which must be submitted with the application would be considered as payment of the visa fee when the application is approved.
