Fortythree States in our country are not subject to the automatic triggering device in the Celler bill. This leaves out the State of Texas where fewer than 50 percent of the people voted in 133 counties in 1960. Texas. Arkansas. Florida and other States are left out because discrimination there is accomplished by means other than a literacy test or device. I fear that the cumbersome court procedures. which will be the only resort in these 43 States. will be inadequate. In addition. the seven States automatically covered and frozen in by the Celler bill are being subjected to what Chairman CELLER himself called. a cruel and harsh measure.
