Opponents of this legislation have argued that the courts have already disposed of the matter in the Camacho case. in which an American of Puerto Rican birth and education sued in a New York State court on the contention that the literacy requirement deprived him illegally of his vote. He lost his case in New York and an appeal to a threejudge Federal court. But. in my view. regarding the Camacho case as final is a serious misreading of the decision. First. the Supreme Court did not rule on the constitutionality of applying New Yorks literacy test to Puerto Ricans. A lower Federal court simply sustained a State court ruling. That hardly constitutes law.
