The defendant. Board of Elections of the City of New York. has refused to allow him to register to vote because he is unable to present proof of literacy in English. as required and provided by sections 150. 168. and 201. subdivision 1. of the election law. These sections were adopted pursuant to article II. section 1. of the New York State constitution. which provides that: Notwithstanding the foregoing provisions. after January 1. 1922. no person shall be entitled to vote by attaining majority. by naturalization. or otherwise. unless such person is also able. except for physical disability. to read and write English. The plaintiff in that case attacked this requirement on more grounds than do the Senators from New York in their amendment. First. he said he was entitled to vote under the treaty which ended the war between the United States and Spain. and which ceded Puerto Rico to the United States.
