Supreme Court is whether or not the Court is assuming powers that upset the balance between the judiciary. the legislative. and the executive. I am appalled at the fact that so few people today are at all aware of the inherent danger of a. kind of judicial despotism that can overtake us. Just a few days ago the Supreme Court said that the Congress of the United States had gone beyond its constitutional prerogatives in legislating on thesubject of immigration and naturalization. The facts in the particular case involved a legislative decision by the Congress that a naturalized citizen who resided for more than 5 years abroad thereby lost his citizenship. The Court. as I have indicated. said that although Congress does have authority to prescribe rules and regulations with respect to naturalization that it did not have constitutional authority to enact such a provision. It is not my purpose here to quarrel with the Courts decision. However.
