Those services include hotels. motels. restaurants. theaters. and related service groups. It is clear from a mere perusal of this section that an attempt is here made to create separate and independent Federal rights and actions. and it is likewise unmistakably clear that no such authority or power is granted to the Congress by the 14th amendment. Section 1 of the 14th amendment states: All persons born or naturalized in the United States. and subject to the jurisdiction thereof. are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States. nor shall any State deprive any person of life. liberty. or property without due process of law. nor deny to any person within its jurisdiction the equal protection of the laws. Section 5 of the amendment provides: The Congress shall have power to enforce. by appropriate legislation. the provisions of this article.
