I now read from a statement on this subject made by Hon. Stanley Mosk. attorney general of California: Neither of these measures is constitutional because of the absence of power in the Congress to enact such legislation. Both measures propose an eradication of literacy tests in the case of a competent person who has received a sixthgrade education. Since literacy tests have generally been held to be valid. analysis requires a determination of the source of this power of eradication. Regarding S. 2750. this power cannot be found under article I. section 4 of the Constitution.
