There is no question that section 349 (a) (4) of the WalterMcCarran Act is applicable in Halperins case. That section of the Immigration and Nationality Act provides that any person who is a national of the United States. whether by birth or naturalization. shall lose his nationality by accepting. serving in. or performing the duties of any office post or employment under the government of a foreign state. and so forth. This is the same section of the law which. pursuant to my urging the Department of State. has applied to American citizens who have entered into the service of Cuba under Fidel Castro. I was glad to note that pursuant to my recommendations these persons were deprived of their U.S. citizenship. and certificates of loss of citizenship required by section 358 of the WalterMcCarran Act have been issued.
