The defendant had been held in contempt for refusing to answer 11 questions relating to whether other persons were members of the Communist Party. but the Supreme Court said that while she might be held in contempt for refusing to answer the first question. she could not be forced to answer any of the others. The Court then went on to vacate the sentence even with respect to the first contempt. and sent the case back for resentencing "in the cool reflection of subsequent events." In the Bonetti case. the Supreme Court revoked the right of the Government to deport an alien who became a Communist after coming to this country. The Court accomplished this by judicial legislation amending the Immigration and Nationality Act in a manner which three dissenting Justices declared "cripples the effectiveness of the act." What the Court said. in effect. was that if an alien becomes a Communist after entering the United States. that subjects him to deportation. but if he can get out of the country and can come back in again before being deported. the past offense is wiped out. and he may ztay here. In the Flaxer case. the Court denied the right of Congress to secure the records of a Communistdominated union composed of employees of Federal. State. and local governments.
