In one section. dealing referred. with travel and control in time of war or national emergencysection 215 of the Immigration and Nationality Actprovision is made for forfeiture of a vehicle concerned in a violation. As it now reads. however. that forfeiture is supplemental to and conditioned upon a criminal conviction of the individual or corporate violator of that section of law. There is no existing provision for total forfeiture of an aircraft as a penalty for violating the aliensmuggling provisions of the statute. This proposal would provide that any aircraft used in violation of section 274(a) (1) or section 274(a)(4) of the Immigration and Nationality Act shall be seized and forfeited to the United States. Aircraft used as a common carrier would not be subject to forfeiture if the illegal act was committed while the plane was unlawfully in the possession of the smuggler. The Attorney General would be authorized to designate officers of the Department of Justice. or the United States generally. who could seize the aircraft.
