The two Acting Commissioners are civilians. but they do not want the appointments because they would have to surrender their civilservice status. It is quite likely that in the future there will be career civilians in the Department of Justice who will be qualified for these positions and who would be willing to accept the positions because by then they will have earned full retirement and may be willing to accept a schedule C position. However. the Commissioner of Naturalization stated that he could not now find any civilservice employee who was fully qualified for either position. nor has he received any application. verbally or otherwise. from any present civilservice employee of the Immigration and Naturalization Service who is desirous of being considered for either position. There is ample precedent for the passage of both bills. It was done in the case of Lieutenant General Erskine.
