Also. there is serious doubt about the constitutional right of the Congress to deprive a man of his citizenship as a criminal penalty. Depriving a felon of his civil rights is. of course. an accepted thing. but depriving a felon of his citizenship. which means his basic nationality. is an entirely different matter. I think it would be a grave mistake to amend the Immigration and Nationality Act in such a way as to render it subject to a court decision declaring a portion of the act unconstitutional. and I think there is no such urgency about the bill H. R. 7130 as to justify the risk in this case. This bill would make it a basis for expatriation to be convicted of a violation of section 2385 of title 18.
