Fish and Game Commission (334 U. S. 410) proves conclusively that Congress has plenary power over the rights and privileges of aliens within the United States. That power stems from the power delegated to Congress over immigration and naturalization. Congress. and not the States. has the power to determine the conditions upon which aliens are permitted to reside in the United States and earn their living. I wonder if the Senator from Ohio has any other authority than the case cited. the Takahashi case. for his contention that the Federal Government. in the absence of treaty. has the delegated powers necessary to implement all of the provisions of a typical treaty of friendship. commerce. and navigation.
