The decision of the Supreme Court in 1948 in Takahashi v. Fish and Game Commission (334 U. S. 410) proves conclusively that Congress has plenary power over the rights and privileges of aliens within the United States. That power stems from the power delegated to Congress over immigration and naturalization. Congress. and not the States. has the power to determine the conditions upon which aliens are permitted to reside in the United States and earn their living. I am confident that the members of the Senate Judiciary Committee who voted to report Senate Joint Resolution 1 with a favorable recommendation would have no objection whatevercertainly.
