I appreciate the great burden that is placed upon the Senate Committee on the Judiciary by a requirement in the lawwhy it was ever enacted I am not quite clearthat the Committee on the Judiciary shall pass upon deportation cases. Obviously that is purely an executive function. Why should a committee of the Senate be required to pass upon the question of whether or not a person is lawfully in the United States? It would be just as reasonable to expect a congressional committee to go to Europe and screen every person who is proposed to be brought to the United States under any immigration law. That is clearly an executive function. Has the Senator ever considered the advisability of repealing that provision of the statute which burdens his committee with 5.000 cases?
