I want to explain to the Members of the House that the War Department has asked for this legislation by letter dated March 6. 1923. addressed to the Speaker of the House of Representatives and states that there is enclosed draft of a bill to amend the Nationality Act of 1940. Section 401 of the Nationality Act of 194054 Statute 11681169. United States Code 8801now provides that a person who is a national of the United States. whether by birth or naturalization. shall lose his nationality by "deserting the military or naval service of the United States in time of war provided he is convicted thereof by a court martial." This is a long letter and I will not read all of it at this time. I am going to read now part of the hearings before the committee and the statement of Col. James E.
