As I understand the situation. if an alien is ordered deported and arrested and the country of his origin or where he belongs refuses to accept him. he is then in custody in the United States. We have had a number of similar cases. as I understand. Russia will not receive a Communist who is ordered deported. Therefore he is in the custody of the United States. and the practice. as I understand it. has been to release him on his own recognizance. The Hobbs bill was introduced here and passed the House in an effort to remedy that situation. but it has not been remedied.
