Session #76 · 1939–41

Speech #760229161

May 29. 1922. This is Mr. Justice Brandeis talking: Congress has power to order at any time the deportation of aliens whose presence in the country it deems hurtful and may do so by appropriate executive proceedings. Similar language was used by the Court on May 12. 1913. in the case of Bagajewitz v. Adams (228 U. S. 585) in which Mr. Justice Holmes used the following language as reported on page 591: It is thoroughly established that Congress has power to order the deportation of aliens whose presence in the country it deems hurtful. Here are the opinions of two outstanding liberals which I deem to be squarely in point on the issue before us.
