An affidavit is required. but such an affidavit would not be a defense if the employer were charged with the offense of having such a person in his employ. I believe the Senator might be doing an injustice to conscientious employers of labor by creating an offense without providing a defense. This amendment would create an offense without providing a defense. Under the terms of the amendment the mere fact that an affidavit is made is not a defense. It is true that the amendment could be redrafted to make it a defense. but. under the terms of the bill which the Senator from Texas will report we shall probably require the deportation of members of subversive organizations.
