Session #76 · 1939–41

Speech #760213052

Of course. Congress could prevent any alien from coming to this country. We have absolute control over immigration. and we could provide that no one could come to this country. But since we have lawfully admitted these persons to the country. they are entitled. as the Court said. to the equal protection of the laws of the several States. I may read just a paragraph from the decision: It is sought to justify this act as an exercise of the power of the State to make reasonable classifications in legislation to promote the health. safety. morals. and welfare of those within- its jurisdiction.
