Mr. Chairman. this amendment is reasonable and can be explained in one or two sentences. The object of the amendment is to make an alien deportable only upon conviction of carrying or possessing arms illegally. We know that practically every State in the Union has laws on this subject and the State courts have the authority to determine whether a person in specific cases carries arms legally or illegally. Otherwise. the Department of Labor would be required to perform the judicial function of determining when a State law has been violated. Aside from the possible conflict that might arise from different interpretations given to State laws by State courts and by the Department of Labor.
